I just found out today that the prosecutor in my ex's case is working on a plea deal. :( They would drop the attempted kidnapping charge, and reduce the aggravated assault charge to a misdemeanor, if she pleads guilty to the misdemeanor assault and stalking. They are currently bargaining over the sentencing. Since I had the restraining order, she could have gotten up to 5 years for the stalking, but if they make a deal it will be a year or two, at the very most, plus she'll be eligible for parole of course. I'm so mad. I didn't get asked about any of this, but I guess I don't get a say.

It seems a peculiarity of the US legal system that lawyers try to avoid the expense of a jury trial and go for 'deals' of lesser charges that can just go before a judge. Apparently it's cheaper and 'frees up' lawyers to take on more cases. Basically turning justice into another type of commerce. Thoughts?

That's exactly what they did to me.

I wanted a jury. I had no records. He did. My own lawyer, which I found in another town, like 3 over actually grew up in the town in which my court hearings were. She left that part out.

I finally figured it out when her assistant scheduled me to see this attorney and I was all hopeful and she came right out and said, "You're here today to tell us when YOU'D like to see your daughter?"

I still had custody. So, I was like WHAT????? There's no way I'm agreeing to anything of the sort. It's going on record that this judge (which they changed from the original judge) took the custody/reversed it and w/out my consent.

He, the ex on the other hand after years of not WANTING to file charges...I finally did, DID have records and officers that would testify.

They wanted me to agree to a deal that had already been made w/out my consent and I wouldn't!
