Hey.. Vicki i was wondering.. How could they sentence him as an adult?..i mean he commited the crime when he was 14. and isnt that make him conserderd a juvenile?..

Welcome to the forum, so glad you joined us!
To answer your question -- It's really about the way "New Mexico Law" is written concerning a charge of 1st degree murder. HOWEVER, seeing that Cody Posey is still 16 years old, Judge Count does have discretion as to whether he will sentence him as an Adult or Juvenile.
On February 20, 2006 Cody's sentencing hearing is scheduled to begin. This is a shocker. No explaination has been given to Why so soon, but I'm sure there is a Very Good reason.
During the sentencing hearing, the Judge will listen to more testimony from psychologists, pre-sentencing evaluations, witnesses, etc. Even the Jurors want to make impact states, on Cody's behalf.
They seem to be very distraught, that Cody is facing 50 years. They didn't know this prior to deliberations.
Letters from Sweden, New Zealand, Canada & all over the world have poured into New Mexico requesting Cody be sentenced as a juvenile. He has support from everywhere.
Also, on Feb. 20th @ 8:00 am. a Rally for Cody will be held in front of the Otero County Courthouse.
On Feb. 19th - a candlelight vigil will take place. People from all over the world are flocking in droves to New Mexico.
If you cannot attend, they are asking Everyone to burn a candle for Cody on that day. "I've Got Mine's!"
February 20th is President's Day. This is not a legal holiday for New Mexico. I will try & keep everyone posted, but Court TV will not air Monday's hearing.
Well, we are down to the wire. If I only had one more wish, I'd spend it right here. I would truly make this all go away.

Gary Mitchell spoke with Jamie Floyd on Court TV Friday. They are going on with the sentencing phase so quickly, because Cody is without rehabilitation.
The facility he's at provides no therapy etc.
Mr. Mitchell, stated he has rec'd faxes, e-mails from North Africa, Alaska & everywhere. He also has opened up 4 add'tl phone lines in his office. Folks are calling from everywhere in support of Cody.
I heard right out of his mouth, that he will take buckets of these letters written on Cody's behalf to Judge Count.
Mitchell, seemed very optimistic that Cody could be sentenced as a juvenile. He would remain locked up til 21, then spend time in half way houses with continued therapy. And, therapy is something that can not be overlooked for Cody. We have to remember he has killed a total of 3 people. And, not 3 strangers.
He's got alot of deep seeded issues to work out. The sooner the better.
In the sentencing phase, evidence which wasn't allowed can be introduced. The generational abuse, within his family. The "sex" stuff and more can come out in Cody's favor.
Send up a Prayer for Judge Counts. He always seemed to want to go with the argument of Mitchell for Cody.
Let's pray for his strength on this.

thank you Vicki.. that stinks that Court TV isn't going to show the sentencing and hearings on Monday.. Hopfully it will be on during the week. I guess i am just going to have to tape everything during the day because I have school. I will DEFINATLY burn more than 1 candle for cody on Sunday!.

Many people must have emailed Court TV -- because they have announced, they are airing Cody's trial.
So, get your VCR or DVR ready. I couldn't even fathom, why they wouldn't do this. They have been following this story from beginning.
I couldn't imagine why CTV would want to miss out on such an important event -- breaking news.
If you are anywhere near a computer, then keep an eye on the forum if you can. I will periodically bring you and others--facts, updates as they are made available to me.
The sentencing hearing is scheduled to begin on Court TV at 11:00 am.
What do you think Judge Count will do? Do you think he's leaning closer to sentencing Cody as an Adult or a Juvenile?
Does anybody have a thought or a feeling, as to what Judge Count is leaning towards?
I'll be glad when this is over. When his decision is finally made.

thank you SO much Vicki. Well as practically like everyone else i am leaning towards juvenile. But i live in Iowa which is no where near New Mexico and i am also 14 years old and have NO idea on the laws in New Mexico. I am so glad it is on Court Tv.. Thank you for the frequent updates and announcements!.

Happy Sunday To Everyone!
Today is the Candlelight Vigil for Cody Posey. I have my candle burning as I type these very words. I will try and find you some details about the mood of the crowd and the happenings going on there. So hold tight.... tomorrow is almost here.
Cody Posey is blessed to have so many supporters, at a time like this.
He's real fortunate to have his own peers support him with their "voice." Their voices can be heard across many miles of our world, including -- Iowa.
It's truly nice to be supported by your peers!

I just looked on the Court TV website at the TV schedule for tomorrow [monday] and it doesnt have the trial things on. So was this decision last minute and they are going to cancel the shows tomorrow and air the trail?.. it said Cody's Trial will resume on Tuesday..

Yes, the decision came after they rec'd a tremendous amount of e-mails.
Court TV announced they will be airing Cody's sentencing hearing at 11:00am EST.
There aren't any trials listed on their website, for Monday, because of the holiday & Cody's will be the only one aired. He is the exception.
I will keep everyone posted as to what is going on.
