Here's an update on my own little DV saga.

My ex had his first pre-trial on Wednesday and the prosecutor gave him this plea bargain: he would be pleading guilty to 3rd degree assault (felony) 15 days jail/work release, 2 years probation, mandatory DV treatment program, and a 5 year restraining order against me. He has until the 30th to decide.

If he doesn't take the bargain, then the case will go to trial next month and he will be charged with 2nd degree assault and if convicted (almost a given since he admitted it in the police report) he would face a sentence of no less than 9 months in jail.

Like a good friend of mine said, they've got him coming and going. He'd be a fool to turn down the plea bargain. My only problem with the offer is I don't think he should have the option of work release, I think he should have to do 15 days straight time.

With work release, does that mean he can leave the jail for a certain amount of hours during the day to go to work?

Yes, that's what it means. He's already homeless and living in a shelter. So my question is, how is letting him work and then giving him free room and board at night a punishment?

No that doesn't seem like much of a punishment. When my abuser was removed from my house, he stayed at a homeless shelter at night and was made to leave during the day. When he was in jail, he enjoyed it because he was off the streets during the day. He is now living with his mommy. She doesn't blame me for leaving him because she said he was always "a little messed up even as a kid". *rolls eyes*
