Judge Kristine Cecava, of Lincoln Nebraska has made a precedented ruling.
She has found that Richard W. Thompson is too short to go to prison.
Thompson age 50, was found guilty of 2 felony sexual assaults against a 12 year old girl.
Thompson, could have been locked away for up to 10 years.
Instead, he received 10 years probation and will be electronically monitored for 4 months.
He was ordered not to be alone with any minor-aged children.
Plus, "Thompson must get rid of his pornography."
The Sexual Offender, stands 5 foot 1 inch tall.
And, the judge feels he just couldn't survive in a prison setting.
Jon Bruning, the state's attorney general, is appealing this decision.

She arrived at this ruling based on these facts.
Judge Cecava found Thompson not only to short, he weighed a mere 125 pounds and he was mentally slow.
Judge Cecava would not discuss any other facts surrounding the case, seeing as it is under appeal.
Thompson had been sexually molesting his fiancee's 12 year old daughter.
The city of Lincoln is outraged and have taken to the streets in protest.

This is terrible....He wasant to short to commit the henious crime was he? How must the poor victim feel?
I had a feeling there was more to it than just a simple question of size..... the fact that he may be 'mentally slow' would leave him vulnerable to victimisation - I'm pretty quick on the draw, but only 4'10"".... life was not always fun, as a youngster....(and I was even shorther then....!) And in the confined and closetted quarters of a relatively dangerous space, there may be much to support her decision. However, it is under appeal, and I would hope a suitable, appropriate and acceptable compromise be found.
However, knowing first-hand how a justice system can positively suck - I'm watching this space.....!

and most likely, dont you think he will do it again?, even though he has 10 years of probation,, he may think that since he got out of prison this time that he could get out of it a second?

Definitely feels the appeal process will bring about a change.
It's not the first time he, nor the citizens have come up against such opposition for a needed change. It's the first time, however, due to the fact someone was to short to go to prison.
If Thompson would have faced the judge 15 days from now, she would have had to given him at least a 15 year mandated sentence.
I understand this is suppose to be a mental illness.
I understand this is not suppose to be about sex...
I guess it's suppose to be about what...planting flowers and mowing the yard?
I realize they need help, but maybe they can find it in prison. Because, continually putting them back out on the streets to repeat their crimes isn't working and it surely isn't fair.
This is turning into a different form of a genocide against these children.
And it has to stop.

this makes no sense, just because he's short he gets a free pass from prison..if you do the crime, you to the time, no if ands or buts....
This is so frustrating...what about the 12 year old girl? She probably wasn't very tall or didn't weigh that much. There has to be some kind of punishment available that would fit the crime committed. I read the story on MSNBC and a prison spokesman said he isn't the shortest person they have in prison. I realize he is 'mentally slow' but he should have more supervision than probation because he has shown he can't be trusted to be left on his own.
i sympathize with the little girl because she needs some sort of justice in this matter, i try not to think of what all she went through because i'm sure she is tramatized by the ordeal....but i dont think this guy should of gotten probation and an ankle bracelet to monitor him..there was a story about a sex offender who got this same sentence and he was at a chuckie cheese taking pictures of young kids..apparently the cops werent paying close attention to his whereabouts but they got him eventually but if this guy is still on the streets he can still attack someone else, and this little girl shouldnt have to feel unsafe or the chance of even running into him again ever in her life
Yep in 10 years he aint gonna grow.
So when he commits a similar crime.... which he will do (these sickos don't stop), he will still be too short for prison.
This really is an unprecedented legal victory for short people. This means one law for the tall and another for the short.
So on and on he will go... what a trooper.
This decision sends out all the wrong signals.
Tax payers' money would be saved, but more importantly, our children would be safe if paedaphiles were put down just like other sick animals.

The judge was worried about him being preyed on because of his height and weight - Wow!
You mean the exact way He preyed on someone younger and smaller in size in weight versus him - isn't that a hoot!
Now, if this Sexual Predator should violate his probation He is only ordered to 30 days in jails -- I will repeat this again.
If, the Sexual Predator violates his probation he is only going to do 30 days in jail.
Where is the justice?

I was watching Anderson Cooper 360, lastnight.
He got a hold of the court transcript.
Once a year, Richard Thompson must do 30 days in jail. It never was actually stated, at least on the program for how many years.
Anderson Cooper, also reported that 2 weeks after Thompson was home, that he became suicidal and went to the hospital.
This was due to the media outside his front door and the citizens protesting in the streets.
